1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Perpetuoso, operated by Perpetuoso LLC, a Texas limited liability company. By accessing or using Perpetuoso, you agree to be bound by these Terms.

2. Description of Service

Perpetuoso is an AI-powered memory and conversation management tool that extracts and stores structured information from AI conversations. AI responses are generated by the Anthropic Claude API.

The service is provided "as is." While we strive for reliability, we do not guarantee uninterrupted availability or error-free operation.

3. Free Tier and Paid Plans

• Free tier: Your first 10 conversations are provided at no charge.
• Pro plan: After 10 conversations, continued access requires a paid subscription at $19/month.
• Pricing is subject to change with 30 days advance notice to active subscribers.
• Subscriptions are billed monthly. Cancellation takes effect at the end of the current billing period.

4. AI-Generated Content

Perpetuoso uses the Anthropic Claude API to generate responses. By using this service, you acknowledge:

• AI responses may contain inaccuracies, errors, or omissions. Do not rely on AI-generated content for legal, medical, financial, or other professional advice without independent verification.
• Memory extraction accuracy is not guaranteed. Always review extracted memories and to-dos for accuracy.
• Perpetuoso's memory system reduces but does not eliminate context loss. Performance depends on conversation length and complexity.
• Use of this service is subject to Anthropic's usage policies at anthropic.com/policies.

5. User Responsibilities

You agree not to use Perpetuoso to:

• Violate any applicable laws or regulations.
• Upload or transmit harmful, illegal, or offensive content.
• Attempt to reverse engineer, hack, or disrupt the service.
• Share your account credentials with others.

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.

6. Intellectual Property

Content you enter into Perpetuoso remains yours. You grant Perpetuoso a limited license to process and store your content solely to provide the service.

The Perpetuoso application, including Perpie the mascot, branding, and underlying code, is the intellectual property of Perpetuoso LLC.

7. Data and Memory Storage

We store your conversation data and extracted memories to provide cross-session continuity. Data is retained while your account is active. We are not responsible for data loss due to technical failures, though we take reasonable precautions to prevent such loss.

We do not guarantee permanent storage of your data. You are encouraged to export important information from your dashboard.

8. Limitation of Liability

To the maximum extent permitted by law, Perpetuoso LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Perpetuoso. Our total liability to you for any claim arising from these Terms or your use of the service shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Disclaimers

The service is provided "as is" without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may terminate your account at any time by contacting us at legal@perpetuoso.com.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Texas.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the updated Terms. Material changes will be communicated with 30 days notice.
